1. Acceptance of these Terms

These Terms govern access to the PARTSMOTORS website and purchases from us. By using the Site, submitting an inquiry, accepting a quotation, or placing an order, you agree to these Terms and the policies incorporated by reference, including our Return, Refund and Cancellation Policy, Shipping, Customs and Import Duties Policy, and Privacy Policy.

If you purchase on behalf of a business, you represent that you have authority to bind that business. A quotation, pro forma invoice, purchase order acknowledgement, wholesale agreement, Incoterms 2020 term, or other transaction-specific written agreement may supplement or replace parts of these Terms for that transaction.

2. Automotive catalog and supply model

The Site contains a large catalog of automotive parts. A listing is not a representation that the item is physically held in our warehouse, currently available, reserved, approved for export, or compatible with a particular vehicle. Supply may be checked after an order or inquiry is received through the Korean automotive-parts supply network.

Availability labels, quantities, prices, supersessions, fitment information, dimensions, weights, lead times, and images may be based on supplier or catalog data and may change. A timestamped written quotation or supply confirmation is more authoritative than a general catalog listing.

3. Order receipt, review, and acceptance

An automated email, payment authorization, or order number confirms receipt, not final acceptance or supply. We may review identity, payment risk, price, quantity, supply, fitment information, shipping feasibility, export control, and compliance before accepting an order.

We may reject, limit, hold, or cancel an order or line item for suspected fraud, price or data error, supply failure, supplier change, export or carrier restriction, sanctions risk, unpaid additional charges, or another reasonable operational or legal ground. If we cancel an amount already collected, we will provide the applicable refund required by our policies and law.

Procurement commitment and cancellation are governed by the Return, Refund and Cancellation Policy. Customer cancellation is normally available only within the stated 24-hour request period and before procurement is committed, whichever occurs first.

4. Prices, currency, and errors

Prices and currencies may change without notice before order acceptance. Taxes, import duties, brokerage, final freight, special packing, remote-area fees, and installation are not included unless expressly stated.

We may correct a typographical, catalog, currency, technical, or pricing error and may cancel an affected order even after payment. We will notify the customer and, where applicable, offer a corrected transaction or refund the affected collected amount.

5. Part identification and fitment

The customer is responsible for checking the exact part number and providing accurate VIN/chassis number, vehicle market, model year, engine, trim, transmission, side/position, and other requested qualifiers. Parts for the same model name may differ by country, production date, option, or specification.

The following statements have different meanings:

• Customer-supplied number: we source the number supplied by the customer and do not independently guarantee fitment.
• Catalog match: a catalog source indicates a possible match, subject to qualifiers.
• Candidate or alternative: further confirmation and customer approval are required.
• Verified for this VIN: PARTSMOTORS expressly confirmed the specified part for the complete vehicle information stated in writing.

Do not install, program, paint, alter, or discard packaging until you have checked the received part. Professional diagnosis and installation may be required. PARTSMOTORS is not the vehicle manufacturer and does not provide automotive repair or safety certification.

6. Product classification and branding

“Genuine,” “OE,” “OEM brand,” “OES,” “aftermarket,” “remanufactured,” and “used” are distinct classifications. We will not treat “OEM quality” or “OE equivalent” as proof that a product was supplied to a vehicle manufacturer. The classification stated in the accepted item or quotation controls.

Manufacturer, vehicle, and part trademarks belong to their respective owners and are used for identification. Unless expressly stated, PARTSMOTORS is not affiliated with or endorsed by a vehicle manufacturer.

7. Shipping, title, risk, and import compliance

Shipping terms are governed by the Shipping, Customs and Import Duties Policy and any transaction-specific Incoterms 2020 rule and named place. Unless we expressly agree to DDP in writing, the customer is responsible for import clearance, duties, taxes, brokerage, permits, and destination-country compliance.

Risk of loss and transfer obligations follow the agreed delivery term and mandatory law. Carrier estimates are not guaranteed delivery dates.

8. Returns, refunds, and warranty

Returns, cancellation, and refunds are governed by our Return, Refund and Cancellation Policy. Many sourced-to-order, electrical, installed, special-order, oversized, hazardous, clearance, and B2B items are not returnable to the maximum extent permitted by law.

Any manufacturer warranty is subject to the manufacturer's terms, territory, proof, diagnostic procedure, and approval. A warranty does not automatically cover international freight, customs, labor, installation, programming, diagnostics, towing, vehicle downtime, or consequential losses.

9. Prohibited use and trade compliance

You must not use the Site or products for unlawful activity, provide false identity or customs information, infringe intellectual property, interfere with security, scrape or reproduce the catalog at scale without permission, evade sanctions or export controls, or resell into a prohibited territory or channel.

We may request end-user, end-use, company, payment, or destination information and may refuse or cancel a transaction when required for sanctions, export control, customs, fraud prevention, manufacturer policy, or carrier compliance.

10. Intellectual property and site content

The Site design, original text, photographs, data compilation, software, and PARTSMOTORS marks are owned by or licensed to PARTSMOTORS. You may use the Site only for legitimate evaluation and purchase. No license is granted for bulk copying, republishing, training a competing dataset or model, or commercial reuse without written permission.

11. Service availability and third-party services

The Site may use Shopify, payment providers, carriers, analytics providers, communications tools, cloud services, and other third parties. Their services may be interrupted or subject to separate terms. We may change or discontinue a Site feature without notice, but this does not remove obligations for an already accepted transaction.

12. Disclaimer and limitation of liability

To the maximum extent permitted by law, the Site and general catalog information are provided on an “as available” basis. We do not warrant uninterrupted access, that every catalog record is current, or that an unverified item fits a particular vehicle.

To the maximum extent permitted by law, PARTSMOTORS is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profit, lost use, vehicle downtime, towing, storage, labor, installation, diagnostics, or loss of business. Our aggregate liability relating to an item will not exceed the amount actually paid to PARTSMOTORS for the affected item.

These limitations do not apply to fraud, wilful misconduct, death or personal injury caused by negligence where liability cannot be excluded, or any other liability or remedy that applicable law does not permit us to exclude or limit.

13. Indemnity for business and unlawful use

To the extent permitted by law, a business customer agrees to defend and indemnify PARTSMOTORS against third-party claims and costs arising from the customer's unlawful use, false customs or vehicle information, unauthorized resale representation, modification, unsafe installation, or breach of these Terms. This clause does not require a consumer to indemnify us for our own fault.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-laws principles. The courts having jurisdiction over PARTSMOTORS's registered place of business in Korea will have jurisdiction, except where mandatory consumer law gives the customer a non-waivable right to another forum or governing law.

Before filing a claim, please contact info@partsmotors.com with the order number and requested resolution so that we can attempt to resolve the matter.

15. Changes, severability, and entire agreement

We may update these Terms for future use of the Site. The version accepted for an order remains relevant to that order unless the parties agree otherwise or law requires a change. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions remain effective.
